India Drug Licence Rules Reshape Pharma Stability Services

India Proposes Immediate Manufacturing Licence Suspension for Drugs Failing Critical Quality Tests

NEW DELHI, India - November 5, 2026 - India’s Union Health Ministry has proposed amending the Drugs Rules, 1945, to allow immediate suspension of manufacturing licences for medicines that fail critical quality tests. The draft rules could raise quality-assurance expectations across the Pharmaceutical Stability & Storage Services Market, which supports shelf-life testing and compliant storage for drug developers.

Under the draft notification, a licence would be suspended once a government-accredited laboratory declares a drug Not of Standard Quality (NSQ). The testing parameters include assay, dissolution, related substances, impurities and sterility.

Until now, suspension or cancellation of a licence has followed a prescribed procedure, such as a show-cause notice. The ministry said this can leave a gap during which a failed drug stays in circulation, which complicates recalls.

A suspension would continue until the manufacturer completes a root-cause investigation and carries out corrective and preventive action (CAPA) that satisfies regulators. Revocation would be permitted only after the licensing authority verifies those measures.

The draft also amends Form 13, the government analyst’s test report. Under the proposal, the report would be sent to the Drugs Controller General of India, the relevant state licensing authority, and the drug’s manufacturer and marketer. The rules are open for stakeholder feedback for 30 days.

According to Next Move Strategy Consulting, the global Pharmaceutical Stability & Storage Services Market was valued at USD 2.05 billion in 2025. It is forecast to reach USD 4.05 billion by 2035, a CAGR of 7.1% from 2026 to 2035.

Key Highlights:

  • Licences would be suspended immediately once a drug is declared NSQ on specified critical parameters, without waiting for a show-cause notice.

  • Reinstatement would require an effective root-cause investigation and verified CAPA.

  • Government analyst reports would reach the national regulator, the state authority, and the manufacturer and marketer.

  • The proposal follows the 65th Drugs Consultative Committee meeting (December 20, 2024) and the 92nd Drugs Technical Advisory Board meeting (April 24, 2025).

Analyst Insight:

NMSC analysts note that Regulatory and Quality Services is the fastest-growing offering in the Pharmaceutical Stability & Storage Services Market, at a 10.2% CAGR from 2026 to 2035, as sponsors outsource protocol design and audit support. NMSC analysis also indicates that India is the fastest-growing country in the market, at approximately 12.2% CAGR over the same period. Tighter licensing consequences could add to demand for documented, audit-ready quality systems among domestic manufacturers.

Industry Outlook:

The draft is open for consultation, and its final text and implementation timeline will determine its effect on manufacturers and service providers. If adopted, manufacturers will face a more direct link between laboratory test outcomes and licence status. That is likely to keep quality documentation, corrective-action capability and testing and storage infrastructure in focus in India’s pharmaceutical supply chain.
